Terms & Conditions

These Terms are published in Czech and English. The Czech version is legally authoritative; this English text is a courtesy translation. In case of any discrepancy the Czech version prevails.
1. Introductory provisions
These Terms govern the contract between the provider — Marek Janda, self-employed entrepreneur, place of business Božetická 3396/8, 143 00 Praha 12 – Modřany, Czech Republic, IČ 71071539, DIČ CZ8208150192, registered in the Czech trade register (živnostenský rejstřík), evidence no. ŽO/01/06903/Jan ("Provider", "we") — and you, the user of the OnceWonder service available at oncewonder.com ("Service").
By creating an account or purchasing credits you agree to these Terms. These Terms are concluded in the Czech and English language; in case of any discrepancy the Czech version prevails.
2. Definitions
- Service — the online application that lets you upload photographs, create characters, locations and items, and use generative AI to produce an illustrated story ("Book").
- Account — your registered access to the Service.
- Credits — prepaid units used to pay for AI generations. Credits are not money, not electronic money, not a means of payment toward third parties, bear no interest, and are non-transferable.
- Generation — a single AI operation that produces an image (or story text) and costs credits.
- User Content — photographs and any material you upload.
- Generated Content — text and images the Service produces from your inputs.
- Consumer — a natural person acting outside their trade or profession.
3. Account & registration
You must be at least 18 years old, or otherwise have full legal capacity to enter into this contract. You must provide a valid e-mail and keep your credentials secure. One person, one account, accurate information. You are responsible for all activity under your account. We may refuse or close accounts created with false information or in breach of these Terms.
4. Description of the service
The Service lets you upload photos and descriptions, from which generative AI (large language and image models operated via third-party providers) creates story text and illustrations in a chosen visual style. Producing images consumes credits; the price of a generation depends on output resolution and image type, as shown in the app before you generate. New accounts receive a number of free credits (currently 100) to try the Service. The Service is provided on an "as-is / as-available" basis and its features may evolve.
5. Credits
Credits are purchased in top-ups and spent on Generations. Credits do not expire. The credit price of each generation type is shown in the app. Credits are deducted (reserved) when you start a Generation. Free credits granted on registration are promotional, hold no monetary value, and are non-refundable. Credits cannot be exchanged for cash except under the refund rules in section 7. See section 8 for what happens when a Generation fails.
6. Prices & payment (VAT)
Prices are displayed in CZK, EUR or USD and are shown excluding VAT. As the Provider is a VAT payer, statutory VAT is added and shown at checkout: our payment provider, Stripe, calculates and displays the final total including VAT before you confirm payment. Payment is processed by Stripe; by paying you also accept Stripe's terms for the payment transaction. A tax receipt/invoice is issued for each paid order. Credits are granted to your balance once payment is confirmed. The Provider may also grant credits manually (e.g. support adjustments).
7. Withdrawal from the contract & refunds
Buying credits is a distance contract for the supply of digital content not delivered on a tangible medium. At checkout you expressly request that provision of the digital content begin immediately and you acknowledge that, by beginning to use your credits, you lose your statutory right to withdraw from the contract within 14 days (Section 1837 of the Czech Civil Code). Accordingly:
- If you have not used any credits from a given top-up, you may withdraw from that purchase within 14 days and we will refund the entire top-up in full.
- Once you have used any credits (started at least one Generation) after that top-up, the right of withdrawal and any refund for that top-up are excluded.
- We do not refund remaining or unused credits in part. Any refund that is due is always the full amount of the whole payment — never partial.
- The free credits granted on registration are not purchased and are non-refundable.
To request a refund, contact us at marek@oncewonder.com from your account e-mail. This clause does not affect the separate, automatic credit reversal for technically failed Generations described in section 8, nor any mandatory statutory rights you have as a consumer that cannot be excluded by agreement.
8. Nature of AI & quality limitations
The Service uses generative AI. Such outputs are inherently probabilistic and will sometimes contain errors, inaccuracies, unexpected elements, artefacts, or only a limited resemblance to uploaded photographs. This is a known, unavoidable characteristic of the technology and not a defect of the Service. We do not warrant that any Generation will be accurate, faithful, complete, aesthetically pleasing, or fit for a particular purpose.
You acknowledge that a satisfactory result may require several attempts and you should keep a reserve of credits to re-generate images you are not happy with. An imperfect but successfully delivered result is not grounds for a refund of the credits it consumed. Where a Generation fails technically — the system reports a failure and produces no image — the credits reserved for it are automatically returned to your balance. This automatic credit reversal is not a monetary refund and is your sole remedy for a failed Generation.
9. User content & user warranties
You retain your rights in User Content. You grant the Provider a non-exclusive, worldwide, royalty-free licence to host, store, process, adapt and transmit your User Content solely to operate and provide the Service to you (including sending it to the third-party AI providers that perform generation). You warrant that:
- you own or have all necessary rights and permissions to upload each photograph and to have it processed by AI;
- where a photograph depicts another identifiable person, you have that person's consent (and, where that person is a child, the consent of their parent or legal guardian) to upload the image and create derived Generated Content from it;
- your User Content is not unlawful, infringing, defamatory, or harmful and does not depict content you are not permitted to process.
You are solely responsible for your User Content. We may remove content or suspend accounts that breach this section.
10. Intellectual property
The Service, its software, visual styles, and branding are owned by the Provider or its licensors; nothing here transfers those rights to you. Subject to full payment and these Terms, the Provider licenses to you the Generated Content produced for you for personal and commercial use, on a non-exclusive basis. You acknowledge that (i) AI-generated output may not be eligible for copyright protection in some jurisdictions and (ii) the AI may produce similar or identical output for other users, so no exclusivity over Generated Content can be guaranteed. You are responsible for how you use Generated Content.
11. Prohibited conduct
You must not use the Service to: create content depicting real identifiable persons without their consent (including non-consensual, deceptive "deepfake", or intimate imagery); create sexual content involving minors or any illegal content; infringe others' rights; harass, defame, or deceive; upload malware; scrape, reverse-engineer, or circumvent limits or security; resell or provide the Service to third parties as your own; or use the Service in violation of applicable law or export/sanctions rules. Breach may lead to immediate suspension or termination.
12. Availability & changes to the service
We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features, and perform maintenance, and we rely on third-party AI and payment providers whose availability we do not control. Unused, non-expiring credits remain available when the Service is restored.
13. Limitation of liability
Nothing in these Terms limits liability that cannot be limited by law, including a consumer's mandatory statutory rights, or liability for harm caused intentionally or by gross negligence. Subject to that, the Provider is not liable for: unsatisfactory or imperfect AI output; indirect or consequential loss; loss of data or content you did not back up; or the acts of third-party providers. To the extent permitted by law, the Provider's aggregate liability arising from the contract is limited to the amount you paid for credits in the 12 months preceding the event giving rise to the claim.
14. Term, termination & account deletion
The contract runs for as long as you have an account. You may request account deletion at any time by contacting support at marek@oncewonder.com; deletion removes your Books and User Content per our data-retention practices (see the Privacy Policy). We may suspend or terminate your account for breach of these Terms or applicable law. On termination for your material breach, remaining credits may be forfeited to the extent permitted by law; otherwise the refund rules in section 7 govern any amounts due. Sections that by their nature survive termination (intellectual property, warranties, liability, disputes) continue to apply.
15. Data protection
The Provider is the controller of personal data processed through the Service, including photographs. Details of what we collect, why, the legal bases, the third-party AI and payment processors we use, international transfers, retention, and your GDPR rights are set out in our separate Privacy Policy at /en/privacy, which forms part of your agreement with us. Because uploads may include images of children, please read it carefully before uploading.
16. Changes to these terms
We may update these Terms (e.g. for legal, technical, or business reasons). We will publish the updated version with a new effective date and, for material changes affecting existing customers, notify registered users by e-mail or in-app a reasonable time before they take effect. Continued use after the effective date constitutes acceptance; if you do not agree you may stop using the Service and request a refund of any qualifying unused top-up under section 7.
17. Governing law & dispute resolution
The contract and these Terms are governed by Czech law. If you are a consumer with habitual residence in another EU/EEA state, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of residence. The Czech courts have jurisdiction, subject to any mandatory consumer jurisdiction rules in your favour.
As a consumer you may pursue out-of-court settlement of disputes through the Czech Trade Inspection Authority (Česká obchodní inspekce, www.coi.cz), the competent ADR body, and EU consumers may use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. You may also raise any complaint with us first at marek@oncewonder.com.
18. Final provisions
If any provision is or becomes invalid, the remainder stays in effect and the invalid part is replaced by a valid provision closest in meaning. These Terms (together with the Privacy Policy) are the entire agreement about the Service. We may assign the contract in connection with a transfer of the business; your rights are unaffected. The Czech version prevails over the English translation. Effective date: 8 July 2026. Version 1.0.
